General Terms and Conditions of GOP Artistical-Theater Essen

of GOP Varieté Essen GmbH & Co. KG (hereinafter referred to as “GOP”)

1. Scope of Application

1.1. These General Terms and Conditions (GTC) apply to all deliveries and services provided by GOP Essen (GOP Varieté Essen GmbH & Co.KG) in connection with the sale and delivery of admission tickets (tickets), vouchers, arrangements, or merchandise items.

1.2. The contractual partner of the buyer and therefore the user of these GTC is the organizing GOP Essen. This also applies to admission tickets sold through authorized ticket agencies.

2. Conclusion of Contract

2.1. Sale of admission tickets (in-/excluding gastronomic service)/merchandise items

The customer submits a legally binding offer to conclude a contract in the online shop when they have completed the ordering process by entering the required details and clicked the "Pay now" button, or when they have communicated the required details during a telephone booking. After receipt of the order (online, by post, or by telephone), the customer receives an order confirmation from GOP, which does not yet constitute acceptance of the offer. Acceptance of the offer only occurs upon dispatch of the ordered admission tickets or upon receipt of the email including the ticket link for self-printing.

If you provided us with your email address when purchasing a product or service (in this case: show tickets, gastronomic products, or vouchers) on our website, we reserve the right to send you follow-up offers. Contact is made on the basis of our legitimate interest pursuant to Section 7 (3) UWG in order to inform you about our own similar products or services. Of course, you can object to receiving such emails at any time free of charge. Data processing is carried out solely on the basis of our legitimate interest in personalized direct advertising pursuant to Art. 6 (1) lit. f GDPR. You are entitled to object to the use of your email address for the above-mentioned advertising purpose at any time with effect for the future. Upon receipt of your objection, the use of your email address for advertising purposes will be discontinued immediately.

2.2. Sale of Events

An event within the meaning of these GTC is defined in particular by the fact that it goes beyond the pure ordering process. An event requires individual consultation. Unless expressly stated otherwise in writing, GOP's offers for an event are valid for two calendar weeks, including Saturday and Sunday. In order to confirm the offer, the event offer must be signed in a legally binding manner – for companies with complete company details, including stamp
. As soon as GOP has received the booking in text form, the booking is completed.

3. Price Components / Payment Terms / Delivery

3.1. Sale of admission tickets (in-/excluding gastronomic service)/merchandise items

3.1.1. The price offered on the day of the order is binding. All prices are inclusive of value-added tax and plus any packaging and shipping costs. The total price of the order including all fees is due for payment immediately upon order or conclusion of the contract. Payment can be made in cash, by bank transfer,  by credit card (VISA Card, Euro Mastercard), as well as by SEPA direct debit. The tickets remain the property of the company until full payment has been received.

3.1.2. The ordered admission tickets (tickets), arrangements, or merchandise items are dispatched via Deutsche Post at the customer's risk. GOP assumes no liability for postal delivery times.

3.2. Events

3.2.1. For a booking with a total value of less than 4,000.00 euros, the total offer price is due immediately. For a total value exceeding 4,000.00 euros, 50% of the total contract price must be paid six calendar weeks before the start of the event, and the remaining 50% two calendar weeks before the event. If payment due dates are exceeded, GOP reserves the right, at its option, to resell or to hold the customer liable. The price offered on the day of the order is binding. Unless expressly indicated otherwise, all prices are end-consumer prices and include the applicable statutory value-added tax.

3.2.2. The dispatch of documents is carried out via Deutsche Post at the customer's risk. GOP assumes no liability for postal delivery times.

4. Retention of Title

4.1. In the case of a consumer, GOP reserves title to the purchased goods until full payment of the invoice amount.

4.2. If the customer is an entrepreneur exercising their commercial or independent professional activity, a legal entity under public law, or a special fund under public law, GOP reserves title to the purchased item until all outstanding claims arising from the business relationship with the customer have been settled.

5. Cancellation / Exchange / Commission / Refund

5.1. Sale of admission tickets (in-/excluding gastronomic service)/merchandise items
Tickets issued to customers or ordered online for self-printing are excluded from return against refund of the purchase price. Should GOP accept returned tickets for resale on commission, to which the customer has no entitlement, this is only possible if the original admission tickets are returned to GOP by the customer. A refund can only be made in the amount of the resale price achieved. For this purpose, an additional rebooking fee of 5.00 euros per ticket applies up to 21 days before the start of the event. Should the booked event be prohibited due to public health considerations, GOP is entitled to postpone the booked date or exchange it for a monetary voucher. If the tickets were purchased as part of a promotion with a reduced price, a rebooking under the same conditions can only take place if the promotion has not yet expired. Otherwise, the prices and promotions valid at the time of the rebooking will apply to the amended date.

5.2. Events

5.2.1. Cancellation/changes in the number of persons for groups of 10 or more persons
In the event of cancellations (cancellation of the contract without replacement) or changes in the number of persons, the following cancellation costs apply:

1.  60 to 45 days before the start of the event 25% of the total contract price

2.  44 to 21 days before the start of the event 50% of the total contract price

3.  20 to 8 days before the start of the event 75% of the total contract price

4.  within shorter periods 100% of the total contract price

A reduction in the ordered number of participants by up to 10% for groups of up to 100 persons and up to 15% for groups of over 100 persons is possible free of charge up to two calendar weeks before the day of the event and must be made in writing.
Thereafter, we charge 100%  of all contractually agreed services according to the agreed number of persons.  This also includes additional services such as hotel rooms, artists, bands, etc. Any cost reductions in the event of cancellation of the event will be passed on to the customer by GOP.

5.2.2. Cancellation by GOP

GOP is entitled to withdraw from the contract with a buyer (reservation of right of withdrawal) if, after the respective contract has been concluded, it emerges that the premises of the event venue are required by GOP on the day of the event for another event and the event for which the buyer has purchased admission tickets can therefore not take place. In this case, GOP will immediately declare its withdrawal in writing to the buyer and immediately refund any services already rendered by the buyer against the return of the admission tickets.

6. Additional Regulations for Voucher Sales

6.1. The vouchers are valid for three years from the date of issue, unless a different expiry period is printed on the voucher or another written agreement regarding the redemption period has been made.

6.2. In the case of vouchers, there is no entitlement to attend a specific event. Rather, attendance depends on whether GOP still has free capacity available for the event in question. The customer must check availability with GOP.

6.3. Activation and enabling of the voucher may take up to five working days. Vouchers purchased online can be redeemed at the latest from the sixth day after purchase.

6.4. All vouchers sold are monetary vouchers, with the result that in the event of price increases between the time of purchase and redemption, the difference must be paid by the customer.

7. Cast / Inability of Artists to Perform / Flow of the Show Program

GOP reserves the right to postpone the event date for good cause. Good causes include, for example, force majeure, absence of artists due to illness, etc. Admission tickets remain valid. Admission fees will only be refunded in the event of a general cancellation of the event up to two weeks after publication of the cancellation. To inform the ticket holder, the publication of the cancellation may take place via the local print media or radio, or, if the telephone number has been provided, also by telephone notification. GOP reserves the right to change the announced cast of the show program even at short notice. Should one or more artists not perform in the program on one or more days, GOP will arrange for an adequate replacement. This does not give rise to any warranty claim, in particular a right of return or a right to a price reduction for the purchased tickets. If, as a result of force majeure, including extreme weather conditions, events must be held late, in a different order, or in an abbreviated manner, this does not entitle the customer to a right of return or a reduction in the purchase price.

8. Decoration / Advertising Materials / GEMA

The attachment or erection of decorative and advertising materials or other items by the customer is only permitted with the consent of GOP. These and other items brought in by the customer must comply with local fire safety and legal regulations; the items must be dismantled after the end of the event. The customer is liable, without proof of fault, for damage to GOP's fixtures or inventory caused during set-up, dismantling, or during the event. GOP bears the GEMA fees for all musical and artistic performances scheduled to be performed at GOP. All further GEMA fees arising from the musical, artistic, or other GEMA-liable services additionally ordered or brought in by the customer shall be borne by the customer.

9. Cloakroom

In the event of damage to the customer's clothing or other items caused by GOP, GOP shall only be liable if the damage is reported to GOP without delay. GOP accepts no liability for damage reported subsequently. In the event of culpable contamination of clothing or other items by GOP, liability is accepted for cleaning costs. Should cleaning be impossible, GOP will compensate for the damage. For this purpose, the customer must provide the required information (receipts or purchase price confirmations) and hand over the garment or item.

10. Limitations of Liability

10.1. GOP is liable in cases of intent or gross negligence on the part of the company or an agent or vicarious agent, as well as in the event of culpably caused injury to life, limb, or health in accordance with statutory provisions. Otherwise, GOP is only liable under the Product Liability Act, due to culpable breach of essential contractual obligations, or insofar as GOP has fraudulently concealed a defect or assumed a guarantee for the quality of the service. However, the claim for damages for the culpable breach of essential contractual obligations is limited to the contractually typical, foreseeable damage, unless another of the cases listed in sentence 1 or 2 above is simultaneously present.

10.2. The provisions of the preceding paragraph 10.1. apply to all claims for damages (in particular for damages in addition to performance and damages instead of performance), regardless of the legal ground, in particular due to defects, breach of duties arising from the contractual relationship, or from tort. They also apply to the claim for reimbursement of futile expenses.

10.3. The provisions under paragraph 10.1. and paragraph 10.2 apply in the same way to liability for impossibility, in particular for the cancellation of an event due to force majeure or similar events for which GOP is not responsible (e.g. official orders, bomb disposals, evacuations, strikes, and curfews, etc.).

11. Right of Revocation

11.1. Exclusion of the right of revocation and return when purchasing tickets and vouchers

Pursuant to  Section 312g (2) No. 9 BGB, there is no right of revocation and return when purchasing tickets and vouchers for a leisure event (here: show performance). This also applies to contracts concluded by means of distance selling (using distance communication methods such as fax, email, internet, or telephone). Every order of admission tickets or vouchers is therefore binding immediately after confirmation by the provider and obligates the acceptance and payment of the ordered tickets.

11.2. Right of revocation for the purchase of merchandise items

Pursuant to  Section 13 BGB, every customer has a right of revocation when purchasing merchandise items. You may revoke your contractual declaration within 14 days without giving reasons in text form (e.g. letter, fax, email) or – if the goods are transferred to you before the expiry of the deadline – by returning the goods. The period begins upon receipt of this instruction in text form, but not before receipt of the goods by the recipient, nor before fulfilment of our information obligations pursuant to Article 246 Section 2 in conjunction with Section 1 (1) and (2) EGBGB, as well as before fulfilment of our obligations pursuant to Section 312g (1) sentence 1 BGB in conjunction with Article 246, Section 3 EGBGB. To comply with the revocation period, it is sufficient to send the revocation or the goods in a timely manner. The revocation must be addressed to the respective GOP Varieté-Theater.

11.3. Consequences of Revocation

In the event of an effective revocation of a contract, we must refund all payments received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us), immediately and at the latest within 14 days from the day on which we received notification of your revocation of this contract. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier. You must return or hand over the goods to us immediately and in any case at the latest within 14 days from the day on which you notify us of the revocation of this contract. The deadline is met if you dispatch the goods before the 14-day period has expired. You bear the direct costs of returning the goods. You only have to pay for any diminished value of the goods if this loss in value is due to handling that is not necessary to check the condition, characteristics, and functioning of the goods.

12. Commercial Resale

The commercial resale of vouchers or admission tickets from GOP is prohibited unless GOP has given its express permission.

13. Offset

The customer is only entitled to offset claims against GOP if their counterclaims have been legally established, are undisputed, or have been recognized by GOP.

14. House Rules

The staff exercises the domiciliary rights on behalf of GOP. Visitors can be expelled from ongoing events if they disrupt them and also disrupt other visitors. In addition, the operator can issue a ban from the premises against these persons. A (partial) refund of the admission price will not be made.

15. Final Provisions

We assume no liability for the misconduct of our guests. When eliminating disruptions to technical or other facilities that occur in a reasonable manner, asserting rights of retention and warranty rights, in particular reduction rights, is not permitted. Should one or more provisions of these General Terms and Conditions be ineffective or invalid, the remaining provisions shall remain unaffected thereby. In place of the ineffective or invalid provisions, a provision shall apply that comes closest to the economic or legal purpose of the invalid or ineffective provision and could have been agreed upon permissibly. The place of jurisdiction is the respective location of the GOP Varieté-Theater. The place of performance is the respective GOP Varieté-Theater or the specified venue. The contractual relationship between the organizer and the customer is governed exclusively by German law.
